GENERAL TERMS AND CONDITIONS – BROOKLYN’S GYM

ARTICLE 1: DEFINITIONS

By registering, you declare that you have read, accepted and will comply with these General Terms and Conditions and the House Rules of Brooklyn’s Gym B.V. The General Terms and Conditions and the House Rules can be found at www.brooklynsgym.nl
.

These General Terms and Conditions enter into force on 01-08-2025 and apply to all new memberships concluded from that date onward.

Offer & Promotion: Brooklyn’s Gym reserves the right to determine which offer applies. The offer applicable at the time of your registration will be stated on our website or in the club (e.g. via kiosk). Any bonus is not applicable to Founding Members or to flexible memberships and does not qualify as a promotion. Bonuses cannot be combined with promotions; if a promotion is applied, the bonus will lapse.

Club: the physical location where Brooklyn’s Gym offers fitness services.

Extras: services or facilities that can be purchased for a fee in addition to the membership.

Host/Hostess: a Brooklyn’s Gym employee responsible for managing a Club.

Commencement Date: the start date of your agreement, being the date of registration or the opening date of the club (if registration takes place prior to opening). If an offer or promotion includes additional free weeks, the start date of the contract term and the first paid period will be postponed accordingly. For example, with a “2-week offer,” registration on 12 May results in payment and the minimum contract term starting on 26 May; during the interim period you may already train free of charge, except for amounts due under Article 5.

Member: a natural person aged at least 16 years. Brooklyn’s Gym may request identification to verify your identity (QR code) or age.

Agreement: the agreement concluded between Brooklyn’s Gym and the Member upon registration, including these General Terms and Conditions, the House Rules and any conditions relating to Extras.

4-Week Period: the periods that make up the agreement and on which payments are based.

1-Year Period: consists of thirteen (13) consecutive 4-week periods.

QR Code: your personal access code (via the app) used to enter the Club.

ARTICLE 2: REGISTRATION AND RIGHT OF WITHDRAWAL

a. You may become a member of Brooklyn’s Gym in the following ways:

Via the website by completing the online registration form (www.brooklynsgym.nl
); or

In the club by completing the registration form at the reception desk.

b. If you register via the Brooklyn’s Gym website, you have the right to withdraw from the agreement within fourteen (14) calendar days after the date of registration without stating reasons, by sending an e-mail to info@brooklynsgym.nl
or by post to: Brooklyn’s Gym B.V., Koperstraat 7, 1362 JB Almere. This cooling-off period does not apply to registrations made in one of our clubs.

If you withdraw within the 14-day cooling-off period and the membership has not been used, the withdrawal is free of charge. If the membership has been used during this period, Brooklyn’s Gym may charge pro rata membership fees from the date of activation up to the date of withdrawal, including the registration fee.

Any refund will be made as soon as possible and no later than 14 days after receipt of your withdrawal request, using the same payment method originally used.

ARTICLE 3: MEMBERSHIP AND TERM

a. Brooklyn’s Gym offers various types of memberships, details of which are available on our website (https://www.brooklynsgym.nl/
) or in the club. We do not guarantee continuous availability of all memberships. Availability may be changed, suspended or discontinued at our discretion at any time. All memberships provide unlimited access during Brooklyn’s Gym opening hours.

A Fit Program membership provides access solely to free training, E-Gym and the Recovery Zone. A Premium Fit Program membership additionally includes access to various small group classes and up to two reformer pilates classes per week.

b. Upon registration, you select the membership type. After the Pre-Sale period, memberships may be concluded for:

A fixed minimum term of 6 months, automatically converted into an indefinite term thereafter, with payment per 4 weeks; or

A fixed minimum term of 12 months, automatically converted into an indefinite term thereafter, with payment per 4 weeks; or

A fixed minimum term of 18 months, automatically converted into an indefinite term thereafter, with payment per 4 weeks.

d. With a Premium Fit Program membership, you may attend reformer pilates classes up to twice per week. This number may be adjusted during the term for any reason. Reformer pilates credits are valid for a maximum of two (2) weeks and will expire thereafter.

e. If you wish to visit our facilities on a one-time basis, you may purchase a day pass on location from the age of 16 (www.brooklynsgym.nl/contact
). The day pass allows access to free fitness and, for an additional fee, small group classes or reformer pilates. The day pass grants single-day access on the activation date.

f. If you change your membership type online, you have the right to cancel that change within 14 days from the date of the change, as described in Article 2(b). In that case, the change will be annulled and your original membership will continue until the end of its original term (and any applicable extensions).

ARTICLE 4: EXTRAS

a. Brooklyn’s Gym may offer various Extras in addition to your membership. These may vary per period. Current information, including pricing, is available on www.brooklynsgym.nl
or in the club.

b. Extras may be added at registration or during the term of the agreement. Ongoing Extras may be terminated at any time with a notice period of four (4) weeks, in the same manner as registration (by letter or e-mail to customer service). If you have chosen a fully prepaid membership, the next possible termination date will be shown in your app. Extras automatically end upon termination of the agreement.

c. Extras are activated immediately. Articles 2 and 3 apply accordingly. For 4-weekly payment memberships, Extra costs are added to the membership fee. For Extras added after commencement, costs are charged pro rata. For fully prepaid memberships, Extra costs are payable together with the membership fee.

ARTICLE 5: FEES AND PAYMENT

a. Each membership type has its own fees and conditions, available on the website or in the club.

b. Brooklyn’s Gym may charge a registration fee, which may vary in case of promotions. Upon re-registration after termination, a registration fee is payable again.

c. Membership fees are due from the moment of registration. All fees are payable in advance via SEPA direct debit unless otherwise agreed.

d. For fully prepaid agreements, the first payment is made at registration. Subsequent payments are collected in advance for the next period. No 4-weekly SEPA debit applies. Upon conversion to an indefinite term, the agreement may be terminated at any time with four (4) weeks’ notice, with pro rata refund where applicable.

e. For 4-weekly payment agreements, the first payment is made at registration; subsequent payments are collected every 4 weeks via SEPA direct debit (13 debits per year).

f–p. Payment obligations, arrears, administration fees, suspension of access, collection costs, VAT, electronic invoicing and price adjustments apply as described in the original Dutch text and are incorporated herein in full.

ARTICLE 6: QR CODE

a. Upon registration, you are advised to download the Brooklyn’s Gym app to access your personal QR code.

b. The QR code remains the property of Brooklyn’s Gym and may only be used during the agreement.

c. Memberships, QR codes and wristbands are strictly personal and non-transferable.

d. Members are responsible for proper use of access credentials. These Terms and House Rules also apply to day-pass holders and promotional visitors.

e. Reasonable limits apply to prevent QR-code fraud, including daily usage limits and device changes.

ARTICLE 7: OPENING HOURS

a. Brooklyn’s Gym determines the opening hours per period. Deviations may apply under certain circumstances, such as public holidays, serious incidents or emergencies. In such cases, the Club may be closed temporarily. This may also occur when maintenance or renovation work is required.

b. Brooklyn’s Gym is entitled to temporarily or permanently amend the opening hours of the Club (or parts thereof) if objective reasons exist. A permanent change may be implemented unilaterally, provided that it is of minor significance in relation to the total number of opening hours or the start or end times. A deviation of up to two (2) hours earlier or later opening and/or closing shall in any event be considered minor.

c. Opening hours shall never be considered an essential condition (conditio sine qua non) for entering into the Agreement. A change in opening hours shall therefore not entitle the Member to terminate the Agreement unilaterally, unless the Member can demonstrate that at least fifty percent (50%) of their Club visits took place at times when the Club is no longer open, with a minimum of four (4) visits during the preceding three (3) months. In such case, Brooklyn’s Gym shall refund any excess membership fees paid on a pro rata basis.

d. Brooklyn’s Gym aims to maintain its Club facilities properly and therefore temporary or partial closures may be unavoidable.

e. The Club makes use of unstaffed hours. For safety reasons, an innovative security system with intercom support is used. In case of an incident, question or emergency, Members may contact the control center via the emergency button. Members are advised to wear a chain with a panic button (available in the Club) during unstaffed hours.

f. Members must ensure that all personal belongings are removed from lockers and changing rooms before staff leave the Club. A fee of €45 may be charged for any request to reopen the changing rooms after this time.

ARTICLE 8: (SMALL GROUP) CLASSES

a. Brooklyn’s Gym continuously updates its class offerings. This means that the content, type and schedule of classes (including small group classes and reformer pilates) may be changed regularly. Occasionally, a class may be cancelled due to insufficient participants (one or fewer).

b. Article 7(c) applies mutatis mutandis to changes in group classes.

c. Capacity and schedules may vary per day. Information is available in the Club or on the website. Each small group class has a limited number of participants. Brooklyn’s Gym does not guarantee permanent access to small group classes (including reformer pilates). Reservations are mandatory via the Brooklyn’s Gym app or online portal.

Reservation conditions:

d. Members may cancel a reservation free of charge up to two (2) hours before the start of the class. Registration is possible up to five (5) minutes before class commencement.

e. Failure to cancel on time or failure to attend constitutes a no-show. The following sanctions apply:
– First two (2) no-shows: warning
– Third no-show and subsequent no-shows: €5 per occurrence

f. Cancellations due to force majeure
In unforeseen circumstances (e.g. illness or emergency), Members may cancel by e-mail (info@brooklynsgym.nl
) or WhatsApp (+31 6 30481794). The administration will assess whether the cancellation qualifies as valid.

g. Brooklyn’s Gym is not responsible for late cancellations due to technical failures.

h. Reservations and waiting list
Members may only register if they genuinely intend to attend. If a class is full, a waiting list applies. When a spot becomes available, the Member will be notified. Allocation is based on a first-come, first-served principle, and Members must still actively confirm their registration.

i. Maximum classes per day
Each Member may reserve a maximum of two (2) different classes per day. Registration for two or more classes of the same type is not permitted, unless an exception is granted by the coach due to last-minute availability.

j. Access to classes
For all classes held in the Flow Studio (Reformer Pilates, Cycling, Yoga and HIIT): once the class has started and the studio door is closed, participation is no longer permitted for safety and focus reasons.
For other small group classes in the functional studio, late entry is allowed until the warm-up phase; arriving later will not be considered a no-show.

k. Schedule
Brooklyn’s Gym may amend the schedule at any time. The schedule shown in the app is always leading over the schedule displayed on the website.

l. Amendment of conditions
Brooklyn’s Gym reserves the right to amend these reservation conditions at any time. The most current version is available via the website and the app.

ARTICLE 9: RELOCATION OR INJURY

a. In the event of relocation, the Member may continue to use the Club. If the Club is located more than 25 km from the new residential address, the Member may terminate the Agreement prematurely with a notice period of four (4) weeks, effective upon receipt of the termination notice. Proof of the new address is required via a copy of municipal registration (not older than three months).

b. Memberships and Extras may be suspended for medical reasons under the following conditions:
– a valid medical certificate from a general practitioner or medical specialist must be submitted;
– the certificate must indicate a required suspension of at least one (1) month;
– suspension takes effect upon receipt and not retroactively;
– suspension applies for a fixed period and ends on the date stated in the certificate or no later than two (2) months after receipt;
– the Agreement term is extended pro rata;
– suspension may be used once per rolling twelve (12) month period.

c. If a medical certificate indicates that the Member will be unable to exercise for at least twelve (12) months, Brooklyn’s Gym shall terminate the membership upon request as of the date of receipt.

ARTICLE 10: TERMINATION OF MEMBERSHIP

a. Fixed-term Agreements may be terminated no later than four (4) weeks before the end of the term. If not terminated, the Agreement will convert into an indefinite term and may thereafter be terminated at any time with four (4) weeks’ notice. Brooklyn’s Gym may terminate likewise.

b. Fully prepaid Agreements follow the same termination rules.

c. Termination may be effected at the Club reception or by e-mail to info@brooklynsgym.nl
, stating full name and termination date.

e. Brooklyn’s Gym may deny access and terminate the Agreement with immediate effect in case of serious or repeated violations of the Agreement, House Rules or unacceptable behavior. Excess prepaid membership fees will be refunded pro rata, excluding registration fees. The objection period is fourteen (14) days.

f. Coaching of other Members is exclusively reserved to Brooklyn’s Gym trainers. Commercial activities or external personal training are prohibited and may lead to termination and damages.

g. Unauthorized access granted to third parties results in liability for the day pass fee plus €50 administration costs and may result in termination after repeated violations.

h. Immediate termination by the Member is only possible in case of serious contractual breach by Brooklyn’s Gym, notified by registered letter within seven (7) days. Brooklyn’s Gym shall never be liable for damages.

i. All other forms of termination are deemed unlawful and all outstanding membership fees remain due. Collection measures may be initiated.

ARTICLE 11: RISK AND LIABILITY

a. Sports involve risks. Participation is entirely at the Member’s own risk and responsibility.

b. Brooklyn’s Gym is not liable for damage or injury resulting from misuse, rule violations or abnormal equipment use, unless attributable to Brooklyn’s Gym.

c. Lockers are used at the Member’s own risk. Brooklyn’s Gym accepts no liability for loss, theft or damage, unless caused by gross negligence or intent.

d. Training programs are followed at the Member’s own risk. Medical consultation is advised in case of doubt, pregnancy or illness.

e. Members must be familiar with evacuation procedures.

f. Massage chairs must not be used on bare skin or under the influence of alcohol or drugs.

ARTICLE 12: COMPLAINTS

a. Complaints should first be addressed to the Club host/hostess and subsequently to customer service as described on www.brooklynsgym.nl
. If unresolved, Article 16 applies.

ARTICLE 13: PERSONAL DATA

a. Brooklyn’s Gym processes personal data in accordance with applicable privacy laws, including the GDPR.

b. Details are set out in the privacy statement available on the website.

c. A security system with intercom is used for safety purposes, excluding toilets, showers and changing rooms.

ARTICLE 14: CHANGES TO PERSONAL DETAILS

a. Changes must be reported immediately to customer service.

b. Failure to do so may result in recovery of incurred costs.

ARTICLE 15: HOUSE RULES

a. House Rules apply and are available online and in the Club.

b. Access may be denied in case of violations.

c. Additional health regulations may apply and violations may lead to immediate exclusion.

d. In case of conflict, these General Terms and Conditions prevail.

ARTICLE 17: APPLICABLE LAW AND DISPUTES

a. Dutch law exclusively applies.

b. Amendments must be made in writing.

c. Invalid provisions do not affect the remaining provisions.

d. Disputes shall be submitted to the competent court.

e. Disputes may also be submitted via the EU ODR platform: http://ec.europa.eu/consumers/odr/
. Brooklyn’s Gym is not obliged to participate in arbitration.
